The New Yorker reported that the government’s case against former NSA employee, Thomas Drake, “appears to be crumbling.” Justice officials have been trying to avoid a trial by offering a plea deal to Drake that if he pleads guilty to a lessor charge, that he can avoid prison. However, Drake apparently is refusing to plead guilty to any wrongdoing. The DoJ is in a pickle because the judge in the case has ruled against them on its request to only provide summaries of some of the evidence because of national security concerns and now if there is a trial, the government has to produce all details of its evidence.
